By accessing and using the services provided by Jay Prasad Majhi ("we," "us," or "our"), including but not limited to AI development, cybersecurity consulting, web development, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations.
If you do not agree with any part of these terms, you must not access or use our Services. These terms apply to all visitors, users, and others who access or use the Services.
We provide artificial intelligence development services including machine learning model development, neural network design, AI integration, and custom AI solutions. Our AI services leverage a 900M+ question-answer database for enhanced performance and accuracy.
Our cybersecurity services include security assessments, vulnerability testing, threat detection, network security implementation, incident response, and comprehensive security consulting for businesses of all sizes.
We offer full-stack web development services including custom website design, e-commerce solutions, web application development, and progressive web applications using modern technologies and frameworks.
You are responsible for maintaining the confidentiality of your account credentials.
You must provide accurate and complete information when using our Services.
You agree to comply with all applicable laws and regulations.
You may not use our Services for any illegal or unauthorized purpose.
All intellectual property rights in the Services, including but not limited to software, algorithms, designs, documentation, and content, are owned by Jay Prasad Majhi or our licensors.
All source code, algorithms, and software provided as part of our Services are protected by copyright and other intellectual property laws.
AI models, training data, and algorithms developed as part of our Services remain our intellectual property unless otherwise agreed in writing.
Security tools, methodologies, and documentation developed by us are protected intellectual property.
Fees for our Services are as specified in your service agreement or project proposal. All fees are quoted in US dollars unless otherwise specified.
Payment terms will be specified in your service agreement. Typically, we require a deposit before work begins, with milestone payments throughout the project duration.
Late payments may be subject to interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.
Both parties agree to maintain the confidentiality of proprietary information received from the other party that is marked as confidential or would normally be considered confidential under the circumstances.
To the maximum extent permitted by applicable law, in no event shall Jay Prasad Majhi be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Services.
Note: Our total cumulative liability to you for all claims arising from or related to the Services shall not exceed the total amount paid by you to us for the Services in the six (6) months preceding the claim.
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of Nepal and the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kathmandu, Nepal.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
